Heard learned counsel for the applicants and learned A. G. A. for the State of U.P. and perused the material available on record.
This application under Section 482 Cr.P.C. has been filed on behalf of applicants with a prayer to quash the charge sheet as well as entire proceedings of Criminal Case No. 525 of 2016 9 State Vs. Shubham and Anr.) arising out of Case Crime No. 57 of 2016, under Section 3/4 of Dowry Prohibition Act, P. S. Gandhi Park, District ? Meerut, pending in the Court of Additional Chief Judicial Magistrate, Court No. 3, Aligarh.
It has been submitted by the accused-applicants-petitioners that it is matrimonial dispute, if positive efforts are made by referring the matter to mediation, there is every likelihood of settlement of grievances.
Issue notice to opposite party no. 2 to appear on 20.09.2016 to apprise the Court about her willingness to mediation.
Apart from normal mode of service steps shall also be taken for service of notice through registered post within a week.
The applicant is directed to deposit Rs. 5,000/- in the High Court according to rules, which shall go to the mediation and conciliation centre and Rs.2000/- shall be paid to opposite party no. 2, per hearing date wise during the mediation proceedings.
List on 20.9.2016.
Till the next date of listing, no coercive steps shall be taken against the applicants in the above referred case.
