Heard learned counsel for the petitioner and learned A.G.A.
By means of present writ petition, the petitioner has prayed for direction in the nature of mandamus directing the police of Police Station Sarai Akil, District Kaushambi to take action against the respondent nos.5 & 6.
It is submitted by the learned counsel for the petitioner that the son of the petitioner was implicated in a case registered as Case Crime No.159 of 2017, under Sections 376,323,506,120-B IPC at police station Sarai Akil, District Kaushambi.
The grievance of the petitioner is that the respondent nos.5 & 6 are extending threat to life and liberty of the petitioner and they have forcibly entered into the house of the petitioner and created ruckus and also trying to oust the petitioner. In this regard he has already moved two applications before the police station concerned and an application was also given to the SHO concerned, but no action has been taken against the respondent nos.5 & 6 till date.
Learned A.G.A. has contended that the concerned S.P. may be directed to look into the grievance of the petitioner for taking appropriate action on the application, if any, moved by the petitioner before the concerned police station.
Considering the facts and circumstances of the case, the writ petition is finally disposed of with the direction that in case any application is moved a fresh within a week by the petitioner in this regard, the Superintendent of Police, Kaushambi, respondent no.2 shall consider the grievance of the petitioner and take appropriate action in accordance with law within one month from the date of production of a certified copy of this order.
