Ms.Nalini S.Lodha, learned advocate appearing on behalf of opponent Nos. 2 and 3, original respondent Nos. 2 and 3 and learned advocate Shri Sandip Patel for Shri Ashish M.Dagli, appearing on behalf of opponent No.1- respondent No.1 waives service of notice of rule. With the consent of learned advocates appearing on behalf of respective parties, present application is taken up for final hearing today.
Present application has been preferred by the applicant original petitioner to restore the main special civil application, which came to be dismissed for non-prosecution vide order dated 13.11.2008.
Considering the averments in the application and as the application is not seriously opposed, the prayer in terms of paragraph No. 6(B) is hereby granted.
Accordingly, main special civil application is restored to file. Rule is made absolute accordingly.
