Heard learned counsel for the petitioner and learned Additional Government Advocate.

Under challenge is FIR relating to Case Crime No. 476 of 2009,under Sections 467,468,420,471,504,506 IPC, police station-Saadatganj district- Lucknow.

We have gone through the contents of the FIR and the other documents annexed hereto.

The argument advanced by the learned counsel for the petitioner is that at the most it is a case under section 138 of the Negotiation and Instrument Act and not with respect to the other sections of the IPC which have been imposed in the FIR.

Since a cognizable offence is made out, the FIR cannot be quashed.

The petition is mis conceived and is accordingly dismissed.
