By order dated 10.10.2017 in Writ-A No.47280 of 2017, filed by the applicants, this Court directed the Principal Secretary (Revenue) to take decision in relation to age relaxation of the applicants having regard to the recommendation made by Collector within a period of six weeks from the date of production of certified copy of the order.
An affidavit has been filed alongwith which the decision taken by the Principal Secretary (Revenue) dated 5.3.2018 in compliance of the direction issued by the writ court has been brought on record.
Counsel for the applicants submitted that recently a judgement has been delivered by a learned single judge in a batch of writ petitions on 28.5.2018, whereby a direction has been issued to the State Government to place all relevant material before the Governor to enable him to form opinion as to whether relaxation in age is to be granted or not.
On basis of the said judgement, it is sought to be contended that the opposite party should have forwarded the claim of the applicant to the Governor.
This Court is unable to accept such contention in as much as the direction by this Court in the writ petition filed by the applicants was to the Principal Secretary (Revenue) to take decision in the matter and in compliance of which, a decision has been taken. Therefore, no ground is made out to proceed in contempt against the opposite party. However, it is left open to the applicants to challenge the decision taken by the opposite party in appropriate proceedings.
The contempt application stands disposed of.
