1. Heard learned counsel for the parties.
2. Learned counsel for the petitioner is permitted to correct the array of parties.
3. Learned counsel for the petitioner submits that despite the fact that in Writ C No. 16385 of 2018 filed by the respondent against the award dated 26.09.2017 has been dismissed by order dated 06.08.2018, the recovery proceedings have been unduly delayed and the proceeding under Section 6-H(1) of U.P. Industrial Disputes Act, 1947 has been kept pending by the respondent no. 1.

In view of the above, without entering into the merits, the writ petition is disposed of with a direction that the respondent no. 1 may seek to conclude the proceeding under Section 6-H(1) instituted by the petitioner vide application dated 31.08.2018 (annexed as Annexure No. 3 to the writ petition), as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order, if there is no other legal impediment.
