Petitioner is a Head Constable in U.P. Police and he has less than two years to retire. Upon his representation, Additional Director General of Police had passed an order of transfer dated 1.5.2018, whereby petitioner was transferred on compassionate ground from District Bulandshahar to District Muzaffar Nagar. Petitioner’s grievance is that despite such orders passed, the authority competent has not relieved the petitioner and, therefore, the order of transfer has not been given effect to.
Learned Standing Counsel submits that in case the order dated 1.5.2018 has not been modified, the authority concerned shall take appropriate steps, in accordance with law.
Having considered the submissions made by the learned counsel for the petitioner, this Court finds that unless the order of transfer dated 1.5.2018 has been withdrawn/ modified/ revoked or stayed, there would be no justification for the authority competent not to relieve the petitioner.
Considering the facts and circumstances, noticed above, this petition stands disposed of with a direction upon the respondent no. 3 to act in furtherance of the order dated 1.5.2018, keeping in view the observations made above, within a period of four weeks from the date of presentation of certified copy of this order.
