Civil Misc. Withdrawal Application No.03 of 2019.
Sri Vijay Prakash Mishra, prays for withdrawal of the appeal filed by the Company and submits that company is duty bound to execute the award. It is submitted that mandatory deposit made under Section 173 of the Motor Vehicles Act before the learned Claims Tribunal be either adjusted against the decretal amount or if some amount is calculated to be surplus over and above the decretal amount then same be refunded to the Insurance Company.
The aforesaid request is accepted and accordingly, Appeal is
dismissed as withdrawn.
