Heard learned counsel for the applicant.
Present contempt application has been filed alleging willful disobedience of the interim orders dated 07.5.2009, 7.4.2011 and 27.11.2017 passed by learned Civil Judge (Junior Division), Mohammadabad Gohna, District Mau in Case No.452 of 2009.
Learned counsel for the applicant precisely submits that the applicant/plaintiff filed the aforesaid case against the opposite party nos.3 and 4 in which an ex-parte interim injunction was passed on 7.5.2009 restraining the opposite party nos. 3 and 4 from careating any disturbance in the land of the applicant but the opposite party nos.3 and 4 have flouted the injunction orders and continued cutting crops of the applicant in violation of the orders of the trial court.
This Court is of the opinion that in case the injunction order accorded by the Court below is being flouted, then the applicant has got efficacious alternative remedy to file an application under Order XXXIX Rule 2A of C.P.C before the Court below. No interference is required in the matter.
The contempt application is disposed of.
