Shrimati Shahnaz Bano And Ors. vs Shrimati Salma Bano And Anr.

Learned counsel asserts that the petitioners never lived with the husband and wife, respondent no.1 and Sri Mohd. Aqeel Ahmad. While the husband and wife lived in a village, petitioners have been living in Lucknow and, therefore, there was no occasion for causing domestic violence. It has also been argued that there is no allegation per se that would indicate that the petitioners have committed any such offence.

Issue notice to the respondent no.1 through the Chief Judicial Magistrate, Lucknow, for 21.8.2012.

In the meantime, no coercive measure would be employed to arrest the petitioners.
