Learned counsel for the petitioner is permitted to implead Laxmi Kant as a party in the writ petition during the course of the day.
When an application was filed for the measurement and demarcation of Plot Nos.117-Ka and 117-Kha, it had been alleged that the respondent no.4, only to bring to naught the efforts of respondent no.1 and respondent no.5 of getting the plot measured, started making certain constructions over the plots in question.
The writ petition is, accordingly, disposed of with a direction that the Sub-Divisional Magistrate, Gyanpur, District Bhadohi may, after allotting a number to the application filed under section 24 of the U.P. Revenue Code, 2006, decide the same within a period of two months from the date of presentation of a certified copy of this order, if there is no other legal impediment. However, if there is any apprehension that respondent no.4 is making constructions on the plots in question, then the petitioner may move an application for interim relief before the Sub-Divisional Magistrate, who shall pass orders on the application within a week from the date of filing of the same. For a period of ten days or till such time orders are passed on the application for interim relief, whichever is earlier, status-quo as of today, shall be maintained.
