THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent.
2. The respondent-police charge sheeted the petitioner (A-3) along with six others in their Cr.No.292/2016 in respect of the offences punishable under sections 344, 367, 323, 504, 506, 326, 307, 420, 370, 384 r/w section 34 of IPC.
3. The allegation is, the victim was introduced to the transgenders/A-1 to A-4 by A-6. They persuaded him to join their group; forcibly his penis was amputated and he was subjected to physical assault etc., The role attributed to this petitioner is similar to that of A-2 who is enlarged on bail by the order of this Court in Crl.P.No.1734/2017 dated 12.4.2017. The investigation since complete, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioner is enlarged on bail in Crime No.292/2016 of respondent- police, subject to the following conditions:
(i) He shall execute a self bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) He shall attend the Court on all hearing dates regularly and punctually.
(iii) He shall not threaten or prevail upon the complainant and the prosecution witnesses.
(iv) He shall not approach the victim directly or telephonically.
(v) He shall not indulge in criminal activities.
