Hon'ble Manish Kumar,J.
Heard learned counsel for the petitioner, learned State Counsel and Sri Virendra kumar Shukla, learned counsel for the Zila Panchayat, Ambedkar Nagar.
It appears that petitioner was awarded some work relating to construction and by means of this writ petition has prayed that a direction may be issued to Zila Panchayat, Ambedkar Nagar for making payment for the work done by the petitioner.
Such issue raised here is pure and simple contractual matter and contractual rights or liabilities would be impermissible to be enforced through a petition filed under Article 226 of the Constitution of India, this writ petition is not maintainable.
The writ petition is, thus, dismissed.
However, notwithstanding dismissal of this writ petition, it will be open to the petitioner to invoke any other remedy, which may be available to him under law.
