2. Smt.Shaila Hegde w/o late Sri Shankar Hegde, Aged about 85 years r/o “Shreeshyala”, 8th Mile Kanakapura Road Bangalore-560 062. ..Petitioners (By Sri N S Sanjay Gowda, Advocate) AND 1. M/s.Sri Bharathi Warehousing Corporation a registered partnership firm, having its registered office at D.No.8-24-31 Mangalagiri Road, Guntur - 522 001, Andhra Pradesh represented herein by its partners.
2. M/s.Polisetty Soma Sundaram (Firm), Guntur a registered partnership firm, having its registered office at Mangalagiri Road Guntur – 522001, Andhra Pradesh, represented herein by its partners.
3. M/s.Shreeshyala Builders (P) Ltd, a company incorporated under the provisions of the Companies Act, 1956 having its registered office at Shreeshyala, 8th Mile Road Kanakapura Road Bangalore-560 062. .. Respondents (By Sri S D N Prasad, Advocate for R1 and R2, R3 – served and unrepresented) This WP is filed under Article 227 of the Constitution of India, praying to set aside the order dated 28.4.2015 passed by the XVII Additional City Civil and Sessions Judge at Bengaluru in OS No.7391/2009 thereby dismissing I.A.No.VI filed by the petitioners herein under Order VII Rule 11(d) of the Code of Civil Procedure 1908 vide Annexure-A.
This writ petition coming on for orders this day, the Court passed the following: -
ORDER Learned counsel for the petitioners has filed a memo dated 22.3.2019 stating that the prayer sought in this petition do not survive, in view of the compromise entered into between the parties.
Memo is placed on record.
The writ petition is dismissed as having become infructuous.
