On 13.12.2011, this Court has issued notice and direct service was permitted.
It is stated by learned counsel, Mr.Patel that respondent No.2 is served and an affidavit is also filed stating that respondent No.2 has refused to accept the service. He, therefore, submitted that fresh notice to respondent No.2 be issued and PI, Mangrol Police Station be directed to serve the notice to respondent No.2.
Under the circumstances, issue fresh notice to respondent No.2, returnable on 13.2.2012. To be served through PI, Mangrol Police Station.
Till then, learned Magistrate concerned shall not pass any order in connection with the Muddamal.
