By means of this writ petition, the petitioner has come to this Court raising a grievance that he is a registered contract and had performed certain contract work with the Executive Engineer, Minor Branch, Canal Unit, Prayagraj. He had raised certain bills but payment has not been made so far and, therefore, through this writ petition, the petitioner has come to this Court stating that the authorities be directed to make the payment of the bill raised by the petitioner.
It is not disputed that it is a purely contractual matter. We do not know as to whether any NOC has been granted or not or whether completion certificate has been issued or not with regard to the work. That apart, being purely contractual matter, the petitioner has either to approach the civil court or in case, there is any arbitration clause he may invoke that clause for redressal of his grievance. Similar view has been taken by a Division Bench of this Court in WRIT - C No. - 11544 of 2014 (M/S R.S. Associate Thru' Prop. Reeta Singh Vs. State Of U.P. & 3 Others) by a judgment and order dated 24.2.2014.
That being the case, no relief can be granted to the petitioner. The writ petition is dismissed.
