Heard learned counsel for the petitioner; learned AGA for the respondent nos. 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report 14.09.2018 registered as Case Crime No. 0194 of 2018, under Section 272, 273 IPC and Section 60 (2) of U.P. Excise Act, Police Station Jalalpur, District Jaunpur.
The allegation is that upon information that at Bhatta of the petitioner (Shreedhar Singh) adulterated liquor was being prepared, a raid was conducted and it was found that liquor was being prepared by lacing it with Urea and Nausadar.
Learned counsel for the petitioner states that the petitioner is innocent and he was not there on the spot and has been falsely implicated.
It is well settled that the defence of the petitioner is not to be considered at this stage because interference, at this stage, with investigation is to be made only when the FIR discloses commission of no cognizable. As the FIR discloses commission of cognizable offence, no case for interference is made out.
The petition is dismissed.
