(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Respondent nos.3 and 4 are permitted to be deleted as opponents. Issue fresh Notice of RULE making it returnable on 9th December 2010 for respondent no.2. Necessary process fee shall be paid by tomorrow, i.e. 19th November 2010; failing which the application shall stand dismissed for default without requiring any further order. If the process fee is paid in time, the applicant shall serve respondent no.2 directly and file affidavit of service before the returnable date.
