The present writ petition has been filed by the petitioners, praying for quashing of the First Information Report dated 05.05.2021 registered as Case Crime No. 165 of 2021 under Sections 147, 148, 149, 323, 504, 506, 307 IPC and under Section 3(i)(d) and 3(1) (dha) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities Act, 1989, Police Station Manda, District Prayagraj with a further prayer to stay their arrest during pendency of investigation of the said case.
The allegation in the first information report is that a dispute took place between two groups in connection with Gram Panchayat election in which the complainants' side was criminally assaulted by the accused persons by bamboo stick and deadly weapons and they received grievous injuries. They were also hurled caste related abuses.
Counsel for the petitioners submitted that the entire family has been falsely implicated.
We do not find it a good ground for quashing the first information report. The writ petition is dismissed with liberty reserved in favour of the petitioners to apply for bail, if so advised, and in which event, the same shall be decided expeditiously without being influenced by any of the observation made in the instant order.
