Heard Shri Santosh Kumar Singh, learned counsel for the petitioner; Shri Sanjay Kumar Singh, learned Standing Counsel for the respondents as well as Shri R.C. Upadhyay, learned counsel appearing for the Gaon Sabha.
The petitioner is before this Court assailing the order dated 24.8.2018 passed by the second respondent, Commissioner, Azamgarh Division, Azamgarh by which he has partly allowed the appeal in question and relegated the matter back to the Sub Divisional Officer concerned for reconsideration on certain issues.
Once the Court has declined to interfere with the impugned order then learned counsel for the petitioner prays that the direction may be issued to the Sub Divisional Officer, Tehsil Sadar, District Ballia to finalize the aforesaid proceeding expeditiously.
Learned Standing Counsel fairly states that in case the aforesaid matter is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the third respondent, Sub Divisional Officer, Tehsil Sadar, District Ballia to finalize the aforesaid proceeding as expeditiously as possible and preferably within a period of two months from the date of production of a certified copy of this order before him.
