Heard learned counsel for the petitioner and Shri Akhilesh Kumar Srivastava, learned counsel for the respondent No. 1.
The petitioner by means of the present writ petition has sought direction upon the respondents to register the petitioner's trust online by opening the portal.
The petitioner is a trust, namely, Shree Prahlad Smark Trust, Village Silthari Post Siddhikala, Tehsil Robertsganj, District Sonbhadra.
According to the petitioner, the petitioner possess requisite eligibility to conduct D-Pharma Course. The portal for registration for approval to run the D-Pharma Course was opened for the session 2019-20. The petitioner could not apply within time. The petitioner did not know the date on which the online portal was opened and closed. Now, the petitioner wants that his application may be considered by the competent authority for registration to grant approval to run D-Pharma Course through online portal.
The petitioner has not applied within time for online registration on the portal for approval to conduct D-Pharma Course, and the counsel for the petitioner could not indicate any provision under which, time can be extended to register the application of the petitioner for grant of approval for D-Pharma Course.
The counsel for the petitioner has relied upon judgement of this Court in Writ C No. 13344 of 2020 wherein this Court has issued a writ of mandamus directing the respondent to consider the application of the petitioner for online registration on the portal for considering his claim for approval in D-Pharma Course. In the opinion of the Court, the judgement relied upon by counsel for the petitioner is not applicable in the present case as this Court has not adjudicated the issue as to whether the court can extend time for registration on the online portal to consider the application after expiry of the last date.
For the reasons given above, the writ petition lacks merit and is accordingly dismissed.
