Heard learned counsel for the petitioners, learned AGA and perused the record.
The present hebeas corpus has been filed by Sri Ram Chandra Pathak, petitioner no. 2, who happens to be the grand father of Shreesh Kumar Pathak and Vishvesh Kumar Pathak whose custody is to be adjudged by District Judge, Maharajganj before whom the proceedings is pending under section 25 of Guardian and Wards Act, 1890 read with Section 6 Hindu Minority and Guardianship Act, 1956. Since the matter is regarding the custody of two children, pending before the District Judge, Maharajganj.
This hebeas corpus petition is misconceived and is accordingly dismissed.
The District Judge, Maharajganj is directed to conclude the proceeding as early as possible within a period of one year provided there is no legal impediment.
