From the perusal of the record, it appears that the Suit being Suit No.91 of 1967 was decreed on 14.4.1967. Thereafter the petitioner filed some application for recall of that decree and that was dismissed in default on 11.11.2000. For the recalling of the order dated 11.11.2000, the petitioner has filed an application on 19.4.2018. The grievance of the petitioner is that the application dated 19.4.2018 is not being decided.
It is, therefore, directed that the application dated 19.4.2018 pending in the Court Sub-Divisional Magistrate, Padrauna, District Kushinagar be decided within a period of one month from the next date fixed in the case, if there is no other legal impediment.
The writ petition is, accordingly, disposed of.
