JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr. Patel, learned APP waives notice of Rule.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to take care of the admission of his child. The birth certificate is produced and the ground appears to be genuine.
It appears from the jail report that the convict has not enjoyed any temporary bail or furlough after November 2010. The jail report further shows that when the convict was earlier released on furlough, he has surrendered in time.
Under the circumstances, the applicant be released on temporary bail for a period of 15 days from the date of his actual release on personal bond of Rs.5000 and one surety of like amount with the further direction that on expiry of the period, he shall surrender with the jail authority.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
