Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicants with the prayer to quash the charge sheet dated 27.5.2021 and cognizance/summoning order dated 14.7.2021 as well as further proceedings of Case No. 5714 of 2021 (State Vs. Shravan Kumar Vishwakarma and others) arising out of Case Crime No. 35 of 2021, under Sections 147, 323, 504, 506, 353, 332 IPC and 2/3 Prevention of Damages to Public Property Act and 7 Criminal Law Amendment Act, P.S. Asothar, District- Fatehpur, pending in the court of Judicial Magistrate, Fatehpur.
At the very outset, learned counsel for the applicants has made a statement at the Bar that he does not want to press the other prayers made in the application and has confined his prayer only to the relief that in case, the applicants appear before the court below and apply for bail, their bail application be considered and disposed of at the earliest.
Learned counsel for the applicant has next submitted that during the course of trial, the applicants were granted anticipatory bail.
Per contra, learned AGA has opposed for expeditious disposal of bail application of the applicants.
In view of the above statement, it is directed that if the applicants appear before the court below and apply for bail, their prayer for bail be considered expeditiously in accordance with law.
With the aforesaid observations, this application under Section 482 CrPC is finally disposed of.
