This application u/s 482 Cr.P.C. has been moved seeking the quashing of entire proceeding of Case No.1138 of 2017 (State vs. Shravan Kumar and others), arising out of Case Crime No.506 of 2014, u/s 420, 406, 506 I.P.C., P.S.-Karanda, District- Ghazipur, pending before the court of Judicial Magistrate, Ghazipur.
Heard Shri Anil Kumar Shukla, Advocate holding brief of Shri Santosh Kumar Srivastava, learned counsel for applicant and learned A.G.A.
Perused the record.
It appears that the applicants have already approached this Court by way of filing Application u/s 482 No.14976 of 2017 (Shravan Kumar Ram And Another vs. State Of U.P. And Another) seeking the quashing of entire proceedings which was refused by another bench of this Court on 12.5.2017 giving the liberty to the applicants to appear before the court below and obtain bail. Some protective direction was also given to the applicants. It appears that once again without any justification the present application has been filed with the similar prayer seeking the quashing of entire proceeding. This is a very undesirable exercise and also a clear misuse of court's jurisdiction. Therefore, in such circumstances this application stands dismissed with cost of Rs.1/- to be deposited by the applicant's counsel today itself in the office of the Registrar General, High Court Allahabad. The token cost has been imposed as the applicants' counsel has tendered his unconditional apology before the Court for this misconduct. The compliance of this order will be reported by the applicants' counsel by way of filing an affidavit in the Court by tomorrow.
