JUDGMENT / ORDER

Mr.
Manan A. Shah, learned advocate has appeared and submitted that he has received instruction to appear on behalf of respondent no.2 and he will enter his appearance for private respondent today. Mr. Rachh, learned advocate has appeared for the petitioner.
Heard Mr.Kodekar, learned APP.
Learned Advocate for petitioner and the learned advocate who has received instruction to appear on behalf of private respondent have submitted that the parties have amicably settled the matter and the complainant does not want to further prosecute the complaint. It is also jointly submitted that the petitioner and the respondent i.e. the complainant or the accused jointly request that the impugned FIR may be quashed. Learned counsel for petitioner has submitted that the terms of settlement have been reduced into writing and the settlement deed dated 27.11.2012 is executed between the parties.
It is also submitted that since the parties jointly request that the complaint/FIR may be quashed, until final order is passed, further proceedings/investigation in connection with the said complaint/FIR may be stayed. Hence, below mentioned order is passed.
Rule returnable on 4th February 2013. In the meanwhile and until the returnable date the ad-interim relief in terms of para 8(B) is granted.
