It is stated that petitioner has been working as Seasonal Collection Peon since 1994.
Petitioner’s grievance is that all of sudden in July 2019, he has been discontinued and other persons who are much junior to the petitioner, have been engaged. It is stated that such action of the respondents is clearly in teeth of the government order dated 29th August 2001.
Records reveal that in respect of such grievance, petitioner has already represented before the District Magistrate, Baghpat and no decision has been taken upon it till date.
Learned Standing Counsel submits that petitioners' grievance shall be examined by the appropriate authority in accordance with law.
Since various factual issues would require determination, it would be appropriate to permit the petitioner to represent his grievance before respondent no.2, within a period of two weeks from today along with certified copy of this order. Petitioner shall be at liberty to annex all materials in support of his claim. The District Magistrate shall pass necessary orders in order to ensure adherence to the government order dated 29th August 2001 or any subsequent government order that may have been issued in that regard. Required decision would be taken, within a period of two months, thereafter. All consequential action would be taken, accordingly.
The writ petition is, accordingly, disposed of.
