Heard learned counsel for the petitioner. Learned Standing counsel has appeared for the respondents.
The petitioner claims that he is the owner of the house situate on plot no. 664 K area 0.7300 hectare situate at Sarvadeeh, Pargana-Sikandra, Tehsil- Phoolpur, District Allahabad and that the private respondents no. 6,7 and 8 are interfering in his peaceful possession and use so as to construct the kharanja road of the Gaon Sabha but there is no resolution of the Gaon Sabha for making such road.
The matter involves ascertainment of factual aspects, as such, we dispose of the writ petition with liberty to the petitioner to make a representation in this regard before the Sub-Divisional Magistrate, respondent no. 2 within a period of two weeks from today and in case any such representation is made, respondent no. 2 shall consider the same and pass appropriate orders in accordance with law after verifying the necessary facts.
The writ petition is disposed of.
