Heard Sri Nagesh Kumar Mishra, learned counsel for the petitioner and Sri Shashi Prakash Singh, learned Additional Solicitor General of India assisted by Sri Prem Shankar Prasad, learned counsel.
The petitioner has invoked the writ jurisdiction of this Court for seeking a direction that his working as the local guide in the Agra Circle may not be disturbed and that a permanent platform may be erected for the working of the local guides over the protected monuments. It is further prayed that the petitioner be provided with a permanent licence to work as a local guide for the protected monuments in the Agra Circle.
The averments as made in the writ petition do not reveal that the petitioner is having any licence to work as a local guide. Earlier, the Court had disposed of several writ petitions with the directions that the petitioners may apply individually for grant of licence to the Superintending Archeologist, Agra or any other officers of the Archeological Survey of India who from time to time may have been designated for grant of the licence and in case any such application is filed the same shall be considered on its own merit having regard to the qualifications and other conditions laid down in the guidelines for the purpose issued from time to time.
In view of the above as we find that the petitioner is not having any licence to work as a local guide, all the reliefs as claimed by him in the writ petition are not admissible to him until and unless he gets a licence for the purpose.
Accordingly, we find no merit in this writ petition and the same is dismissed with liberty to the petitioner to apply for licence.
