Heard learned counsel for the petitioner and Sri Saran who appears for the Commission.
This petition has been preferred for a direction being issued commanding the Commission to permit the petitioner to submit her testimonials and to consequently appear in the interview.
The Commission, which was asked to obtain instructions, has apprised the Court that the last date for submission of documents was 01 May 2017. The Court is informed that the petitioner did not submit the testimonials on or before the last date fixed. The explanation proffered is that the petitioner had, in the meanwhile, got married and left the residential house and consequently could not derive knowledge or notice. This explanation cannot possible be countenanced since the petitioner was made aware of the last date fixed in the advertisement issued by the Commission. She was therefore, obliged to ensure that the documents were submitted on or before the last date fixed.
Learned counsel for the Commission additionally informs the Court that intimation of the dates fixed by the Commission for submission of testimonials was also sent to all candidates via SMS. In any view of the matter and bearing in mind the principles enunciated by the Full Bench of the Court in Rajendra Patel v. State Of U.P. And Another [2015 (8) ADJ 219 FB], the Court finds no merit in the petition which shall stand dismissed.
