In compliance of the earlier order of this Court learned Standing Counsel has placed instructions in which it has come to be recorded that even the petitioner has encroached upon the chak road on plot No. 365 on which the total area 0.045 hectares.
On a pointed query being made to the learned counsel for the petitioner he agrees that plot No. 365 is also agricultural holding of the petitioner.
In view of the fact that there is an encroachment by the petitioner and the petitioner has approached this Court, it clearly transpires only a dispute between to encroachers.
In any view of the matter since the petitioner himself has encroached upon the land of the chak marg, this writ petition is disposed of with a clear direction to the concerned authority immediately get the petitioner and other encroacher vacated/ evicted from the encroachment by proceeding in accordance with law.
