Heard Sri Manoj Pandey, learned counsel for the petitioner, learned Standing Counsel for the State respondents and Sri Azad Rai, learned counsel for the respondent no.3. Perused the record.
The present writ petition has been filed for issuance of direction in the nature of mandamus commanding the respondent no.2, Sub Divisional Magistrate, Tehsil Sadar, District Gautambudh Nagar to decide the Case No.02 of 2020 (Shiv Raj Vs. Dharamveer and Others), filed under Section 134 of U.P. Revenue Code, 2006.
It is contended by learned counsel for the petitioner that the suit was filed by the petitioner for eviction of respondent nos.4 to 8 from the land in dispute as they are occupying the same without any title.
Order sheet reflects that the suit has been filed on 07.03.2020 and no effective date has been fixed due to Pandemic Covid-19.
Under the circumstances, suit is filed in the year 2020 itself, no ground for issuance of any mandamus to the concerned authority is made out.
