Heard Sri Prashant Kumar, learned counsel for the petitioner, Sri A.K.Sand, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the order dated 28.11.2017 passed by respondent no.2 in S.T.No.496 of 1980, under Sections 302/34, 201 I.P.C., Police Station-Kishni District Mainpuri.
Learned counsel for the petitioner submits that the controversy involved in the present petition stands concluded vide judgment and order dated 28.1.2016 passed by Coordinate Bench in Crl. Misc. Writ Petition No.15151 of 2014. He further submits that the present writ petition may be disposed of in the light of the said judgment and order dated 28.1.2016.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considered the submissions advanced by learned counsel for the parties.
We dispose of this writ petition with the same directions subject to which Crl. Misc. Writ Petition No.15151 of 2014 was disposed of by another Bench of this Court vide judgment and order dated 28.1.2016.
