Heard learned counsel for the parties.
By means of the present writ petition, the petitioner seeks to challenge the transfer order dated 16.3.2018 on the ground that the petitioner had suffered from the disease namely Chikungunya for a certain period and as a side effect of the said disease, he is now suffering from Rheumatoid arthritis.
The petitioner is under treatment of a Rheumatologist based at New Delhi, who has advised the petitioner to take treatment for about six months.
Submission is that the petitioner may be accommodated at Ghaziabad so as to facilitate him to consult his Doctor at Delhi.
This contention of the petitioner is not sufficient to interfere in the transfer order inasmuch as, the petitioner is transferred from Ghaziabad to Baghpat, which is an adjacent town to the Meerut and is close to Delhi. The petitioner cannot be accommodated in Ghaziabad itself for the sole reason of being suffered from Rheumatoid arthritis which is an irreversible disease.
For the above noted reasons, this Court does not find merit in the contention of the petitioner so as to interfere in the transfer order.
It is directed that the respondents authorities shall relieve the petitioner immediately and he shall join at the new place of posting within the shortest possible time. After joining, it would be open for him to ventilate his grievances before the competent Authority.
Dismissed.
