2. This petition has been filed praying for a direction to be issued to the respondent no.2 to decide partition suit filed under Section 176 of the U.P. Z.A. & L.R. Act on 09.05.2012, Case no.T20204710800976: Shivpati and others Vs. Shyamlal and others.
3. It has been submitted by learned counsel for the petitioners that once the case was dismissed for non prosecution in 2017, it has been restored to its original number on 12.03.2020. Even after restoration more than one year has passed, no hearing on the merits of the case has taken place.
4. This petition is disposed of with a direction to the respondent no.2- Sub Divisional Officer, Tehsil Tiloi, District Amethi, to consider and decide the pending partition case before him at the earliest, say, within one year from the date a copy of this order is produced.
