Heard learned counsel for the petitione learned Standing Counsel for respondent no. 1 and Sri Prajnal Mehrotra, learned counsel for respondent nos. 2 and 3.
Learned counsel for the petitioner submitted that he was initially appointed on the post of peon on 30.07.1985 in U.P. Jal Nigam, Ghazipur and after attaining the age of superannuation, retired on 31.01.2018. He further submitted that even after around eight months of retirement, he has not been paid the post retiral benefits and for that purpose, he has moved a representation dated 24.5.2018, but the same has not been decided by respondent no. 3. He further submitted that when no action has been taken, he has moved another representations dated 17.07.2018 and 27.08.2018 before respondent no. 3, but till date, neither payment was made nor any decision was taken on the representations moved by the petitioner. Lastly, he prayed that a suitable direction may be issued to respondent no. 3 to decide the representation of the petitioner dated 27.8.2018 within a time bound manner.
Learned counsel for the respondents has no objection to the prayer made by the petitioner.
Considering the facts and circumstances of the case, with the consent of parties, without adverting the merits of the case, the writ petition is disposed of with direction to respondent no.3 (Executive Engineer, U.P. Jal Nigam, 3rd Construction Divisiion, Ghazipur) to decide the representation of the petitioner dated 27.8.2018 strictly in accordance with law within a period of two months from the date of production of certified copy of this order. However, it is open for the petitioner to file a fresh representation along with certified copy of this order.
