It has been brought to our notice that pursuant to the Court's order, certain action has been taken by the Ahmedabad Municipal Corporation. It is informed that some of the buildings have been sealed, details of which has been given at page no.125 of Misc. Civil Application No. 2692/2010. Learned Sr. counsel Mr. Nanavati appearing for the applicant in Civil Application No. 13617/2010 submits that the applicant-Association has already taken steps for ensuring fire-safety and the work will be completed within a month. In the meantime, seals may be opened to allow the shops and other institutions like Banks, Post Office, etc., to function. Mr. Mihir Thakore, learned Sr. counsel appearing on behalf of the petitioners in Spl. Civil Application No. 14539/2010 referred to the Gujarat Regularization of Unauthorized Development Rules, 2001 and submitted that the members of the Association may be allowed to file application for regularization of their unauthorized construction/user. He stated that the petitioners will give proposal for car parking and the members are ready to make provision for fire-safety within a reasonable period.
In the circumstances, we allow the parties to submit their proposal. Post the matter on 23rd November 2010 at 2:30 pm. In the meantime, the Ahmedabad Municipal Corporation may allow the Banks, Government institutions, advocates/law firms, dispensaries, etc., to function. If any building has been sealed in which Banks, Government Institutions, etc., are functioning, they may be opened for running their business.
