Ref:- Criminal Misc. Correction Application No. 01 of 2019.
By means of this application prayer has been made for correcting the order dated 08.05.2019 by deleting Section 366 and replacing it by Section 366-A. Although, in the bail application, 366-A was typed but 'A' has been scored out. Further, the FIR was registered u/s 363 only. The rejection order passed by the court below does not refer to Section 366-A but refers to Section 366 in addition to other sections.
According to learned counsel for the applicant, the charge-sheet contains Section 366-A and not section 366 as such, the correction may be incorporated.
Learned AGA submitted that until and unless the rejection order deals with Section 366-A and is corrected, this Court may not incorporate any such correction.
Accordingly, Sri Vinod Kumar Srivastava, Advocate holding brief of Sri Gulab Chandra, learned counsel for the applicant states that the present correction application may be rejected with liberty to file fresh, after the rejection order is got corrected.
