By accepting Criminal Misc. Transfer Application No. 258 of 2017, this Court transferred the Sessions Trial No. 35 of 2017 arising out of Case Crime No. 6 of 2017 from the Court of Sessions Judge, Chandauli, District Chandauli to the Court of Sessions Judge, Ghazipur, District Ghazipur. The petitioner is a witness in the trial aforesaid and he is apprehending some injury to his person, thus, he submitted an application to the District Magistrate, Chandauli to provide necessary security while going to Ghazipur to adduce evidence in the case concerned.
On being failed to have any order on the representation submitted to the District Magistrate, the instant petition for writ is preferred.
From perusal of the facts stated in the petition for writ, it appears that the matter was listed before the trial Court on 16.02.2018 and the petitioner attended the Court. The petitioner being a witness, if is having any apprehension with regard to his security then the appropriate course before him is either to submit an application to the Prosecutor concerned to provide necessary security or to move an application before the trial Court to provide complete protection. No direction in this regard is required to be given by the District Magistrate. The writ petition, hence, is dismissed. The petitioner is at liberty to move an appropriate application before the Prosecutor as well as before the trial Court for redressal of his grievance.
