M/S Shivcharanlal Ambikaprasad Glass Works vs State Of U P And Others

JUDGMENT / ORDER

Court No. - 7
Case :- WRIT - C No. - 42899 of 2018 Petitioner :- M/S Shivcharanlal Ambikaprasad Glass Works Respondent :- State Of U P And 3 Others Counsel for Petitioner :- Radhey Shyam Dwivedi Counsel for Respondent :- C.S.C.
Hon'ble Saumitra Dayal Singh,J.
1. Heard learned counsel for the parties.
2. At present, the petitioner's objection filed to the application moved by the respondent nos. 3 and 4 for payment of wages is pending. In that proceeding, the petitioner also appears to have raised an objection to the effect that the application had been filed by the said respondents on a wrong proforma. He therefore prays that, the application ought to be rejected in terms of Rule 7 of the U.P. Payment of Wages (Procedural) Rules, 1958.
3. Since admittedly, the objection is still pending, and no final order has been passed on the notice issued by the respondent Authority, the present petition is disposed of with the direction that all objections as may have been raised by the petitioner before the respondent no. 2, may be determined by a reasoned and speaking order before any orders are passed on merits as to the wages claimed by the respondent nos. 3 and 4. Such decision may be made as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of the order, after affording due opportunity of hearing to all affected parties.
