The challenge is to the notice dated 05.02.2021 issued by the respondent no.3 calling upon the petitioner to show cause as to why it may not be black listed.
As there is nothing in the writ petition to indicate that the petitioner has submitted any reply to the said show cause notice. The reply to the letter dated 27.01.2021 issued by the respondent cannot be treated as reply to the show cause notice.
As the challenge is to the notice, we do not find any good ground to entertain the present writ petition.
However, liberty is granted to the petitioner to submit a reply within a period of three weeks from today. In case the petitioner submits the reply, the competent authority shall be under obligation to take an expeditious decision considering the explanation offered by the petitioner in accordance with law.
The writ petition is disposed of.
