Pursuant to the order dated 29.05.2019, which was passed in the presence of Mr. Lal Chandra Misrha, Advocate holding brief Mr. Vinod Kumar Srivastava, learned counsel for the applicant in which Mr. Vinod Kumar Srivastava, learned counsel for the applicant as well as deponent Ramendra Kumar Tiwari were directed to file their personal affidavits explaining as to why contempt proceedings be not initiated against them. Thereafter, several orders were passed and time was given to learned counsel as well as deponent to file their personal affidavits explaining their conduct.
Today, personal affidavits have been filed in pursuance of order dated 29.05.2019 by Vinod Kumar Srivastava, learned counsel for the applicant as well as deponent Ramendra Kumar Tiwari, respectively in which they have also tendered unconditional apology for the inconvenience caused to the Court. Said affidavits be kept on record.
Learned counsel for the applicant prays for and is permitted to withdraw the bail application.
Accordingly, bail application is dismissed as withdrawn.
Mr. Vinod Kumar Srivastava, learned counsel for the applicant and the deponent are warned to remain careful in future in filing affidavit in the Court.
The certified copy of relevant papers be returned to the applicant after retaining photocopy of the same on record.
