Heard learned counsel for the petitioners, Mohd. Abid Ali, learned counsel for opposite party No.2 and learned A.G.A. for the State.
This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of certiorari to quash the impugned F.I.R. dated 13.07.2018 registered as Case Crime No. 388 of 2018, under Section 376 IPC, Police Station- Collector Bookganj, District- Bareilly.
Learned counsel for the petitioners stated that the respondent No.4 (Kiran) is the informant and victim of the present case and she had married with petitioner No.1 (Shivam) and both of them compromised the dispute and living happily. Petitioner No.2 who is also the victim is respondent No.4 has also made petitioner No.2 in the present petition. Learned counsel for the petitioners stated that inadvertently he has made the victim also the petitioner in the present petition and prays that petition be dismissed as withdrawn with liberty to file fresh.
The prayer made for is allowed.
Accordingly, the present petition is dismissed as withdrawn with liberty to file fresh.
Office is directed to return the certified copy of the F.I.R. to learned counsel for the petitioners after retaining a copy of the same.
