The prayer made in the instant petition is for issuing direction to the court below to decide Marriage Petition No.42 of 2018 under Section 13 of the Hindu Marriage Act, 1955 within a specified time frame.
Counsel for the petitioner points out that the defendant has entered appearance in the proceedings. However, written statement has not been filed by her so far.
Section 21-B of the Hindu Marriage Act specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent.
In view of the aforesaid provisions under the Act, I am of the opinion that no further direction is required.
The petition is accordingly disposed of.
