JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.38206 of 2014 Dated: 12.12.2014 Between:
M/s. Shivam Smelters Private Limited Rep. by its Director Mr. Lokesh Kumar Agarwal .. Petitioner and The Southern Power Distribution Company of Telangana Limited, Rep. by its Chairman and Managing Director and others.
.. Respondents Counsel for the petitioner: Mr. D.V. Nagarjuna Babu Counsel for the respondents: Mr. S.V. Ramana for Mr. O. Manohar Reddy The court made the following:
ORDER:
This writ petition is filed for a Mandamus to declare the action of the respondents in demanding a sum of Rs.37,48,813/- in the bill for the month of November 2014 as highly illegal and arbitrary.
A perusal of the record shows that on receipt of the bill, the petitioner made a representation on 03.12.2014 to respondent No.3, wherein it is stated that the head “other charges-(I)” mentioned in the impugned bill does not contain any particulars as to how the petitioner is found liable to pay that amount. The grievance of the petitioner is that instead of supplying the details of the said charges, the respondents are proposing to disconnect the power supply for non-payment of the demanded amount.
Mr. S.V. Ramana, learned counsel representing Mr. O. Manohar Reddy, learned Standing Counsel for the respondents, while pointing out that though the bill was dated 26.11.2014, the petitioner has made a representation only on 03.12.2014 i.e. about one week before the expiry of last date for payment, has, however, fairly submitted that respondent No.2 will consider the petitioner’s representation and furnish the details within one week. For a period of one week thereafter, the respondents shall not disconnect the power supply to enable the petitioner to decide on the further course of action.
Subject to the above direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.47808 of 2014 shall stand disposed of as infructuous.
