Heard learned counsel for the petitioner and the learned counsel for opposite parties.
In compliance of the order of this court dated 25.1.2012, opposite party No. 4 Block Development Officer,Dalmau, Raebareli is present along with record.
The perusal of the record shows that the name of the petitioner was not recommended for training and names of only 34 candidates were recommended for training. It is further submitted that the name of the petitioner was not recommended by the selection committee and there is a mandatory provision for entering into an agreement which is to be signed by the petitioner and the District Magistrate and the same was not done, therefore, there was no occasion for petitioner to be appointed on the post of Panchayat Mitra.
Learned counsel for petitioner has filed certificate of training issued by the Acharya Kshetriya Vikas Sansthan, Raebareli in which it is stated that the petitioner had taken training from 27.1.2007 to 29.1.2007. The petitioner has also filed annexure -5 which is a list of 119 candidates who received training and this list has been issued by the Acharya Kshetriya Vikas Sansthan, Raebareli. It is really strange that while the name of the petitioner was not recommended for training how training was imparted to him and under what circumstances the said certificate was issued in favour of the petitioner.
In these circumstances, the Acharya Kshetriya Vikas Sansthan, Raebareli becomes necessary party. Learned counsel for petitioner prays for, and is granted two weeks time to take steps for impleadment of Acharya Kshetriya Vikas Sansthan, Raebareli as party in the petition.
The Block Development Officer Dalmau Raibareli who is present today need not appear again unless called for.
