The present petition seeks a direction upon the Family Court, Shahjahanpur to decide recall application dated 24.08.2018 filed by the respondent in Original Suit No.336 of 2016, under Section 13 of the Hindu Marriage Act, within a stipulated period.
It appears that the court had directed the matter to proceed against the opposite party ex-parte and therefore the opposite party had put in appearance and moved an application under Order 9 Rule 7 CPC, which is stated to be pending.
Ordinarily, divorce proceedings are to be dealt with expedition and therefore it is provided that in absence of any legal impediment the trial court shall endeavour to proceed with the matter expeditiously, in accordance with law, by addressing the application of the opposite party.
The petition is disposed off.
