Heard learned counsel for the petitioner and learned Additional Government Advocate. Gone through the writ petition.
The present writ petition has been filed with the prayer for quashing First Information Report relating to case crime no. 180 of 2010 under Section 147, 148, 149 188, 436 & 427 IPC read with Section 3/4 of the Public Property Act 1984 and 7 Criminal Law Amendment Act of Police Station Krishna Nagar, district Lucknow.
We have gone through the contents of the First Information Report. Since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is accordingly dismissed.
However it is provided if the petitioner surrenders before the court below and moves application for bail, his bail application shall be heard and disposed of expeditiously by the Courts below.
