Heard learned counsel for the applicant, learned AGA and perused the record.
Present application under Section 482 Cr.P.C. has been filed by the applicant in which the applicant has challenged the order dated 19.09.2019 passed by Special Judge SC/ST Act/ Additional Sessions Judge, court No. 2, Saharanpur in ST No. 31 of 2019 (State vs. Shivam Chauhan), arising out of Case Crime No. 921 of 2019, under sections 323, 504, 506 IPC and Section 3 (1) Da, Dha of SC/ST Act, P.S. Kotwali, District Mainpuri.
Learned counsel for the applicant has submitted that at the time of incident applicant was juvenile, however, the Special Judge SC/ST Act Mainpuri has passed the order dated 19.09.19.
I don not find any illegality in the order dated 19.09.2019. The applicant has to surrender before authority of law.
Thereafter, he may appear before appropriate Board, where he may claim his juvenility.
This application is devoid of merit and is accordingly dismissed.
